The terms and conditions governing the use of Remixary

Remixary ("Remixary", "we", "us") is operated by Ye Hailun, a sole trader, who also goes by Helen Yeh. You can reach us at support@remixary.com; we monitor that address and reply to billing and account requests within one business day.
By creating an account or using the service you agree to these Terms. If you do not agree, do not use the service.
Remixary is a software-as-a-service tool for producing video advertising variants. You upload a reference video, the service decomposes it into a shot structure, substitutes your product, and generates new video, voiceover and captions. Everything is delivered digitally; there is no physical product.
The service is provided "as is". We do not guarantee that generation will always succeed, that output will suit a particular campaign, or that the service will be uninterrupted.
Generation runs on third-party AI models. As of this version:

Your prompts and uploaded material are sent to these providers to produce your output, and are subject to their own safety controls. We may change or add models as the field moves; where a change materially affects output quality or the handling of your data we will say so before it takes effect.
You must give accurate registration information and you are responsible for activity under your account. Do not share credentials. Tell us at support@remixary.com if you believe your account has been used without your permission.
The service is metered in credits. One generation consumes credits according to its length and the model used.
Free credits. Every new account receives 50 credits on sign-up. No payment method is required to use them.
Subscriptions. Starter ($49/month), Team ($149/month) and Agency ($399/month) each include a monthly credit allowance. Subscription credits expire one calendar month after they are granted; they do not roll over.
Credit packs. Packs of 100, 200, 500 and 1,000 credits can be bought separately at $9.90, $14.90, $39.90 and $69.90. Pack credits are valid for 24 months from purchase and remain available even if you cancel a subscription.
Automatic renewal. Subscriptions renew automatically each month at the then-current price until you cancel. By subscribing you authorise us and our payment processor to charge your payment method on each renewal date. We will email you before any price change takes effect.
Payment processing. Payments are processed by Waffo Pancake, operated by Waffo.com Limited, which acts as the merchant of record and reseller for your purchase and also handles order-related inquiries and returns. Your card details are entered on their checkout and are never received or stored on our servers. Your card statement will show the descriptor presented at checkout.
Taxes. Prices are exclusive of tax unless stated. Any sales tax or VAT is calculated and collected by the merchant of record at checkout.
You can cancel your subscription yourself at any time from Settings → Billing inside the product. Cancellation takes effect at the end of the current billing period: you keep access until then and are not charged again. You do not have to email us to cancel.
To change plans, email support@remixary.com and we will handle it within one business day.
The baseline. Remixary is a digital service delivered instantly, and each generation consumes third-party compute that we pay for at the moment you use it. Once credits have been consumed they are therefore not refundable. The exceptions below are real and we honour them without argument.
1 — Failed generations are never charged. Credits are placed on hold when a job starts and are only settled once output has been delivered and passed our delivery checks. If generation fails, the hold is released and your balance is unchanged. You do not need to file anything, and there is nothing to refund because nothing was taken.
2 — Unused purchases, 7 days. If you have not consumed any credits from a purchase, email support@remixary.com within 7 days of payment and we will refund it in full to the original payment method.
3 — Duplicate or erroneous charges. If a billing fault charges you more than once for the same purchase, or charges you after you cancelled, we refund the surplus in full. This is not time-limited — tell us whenever you notice it.
4 — Extended outage. If the service is unavailable through our fault for more than 72 consecutive hours, tell us and choose either a pro-rata refund of the affected subscription period or an equivalent extension of your plan.
5 — Your statutory rights are unaffected. Where the law of your country gives you a withdrawal or cooling-off right — for example the 14-day right for consumers in the EU and UK — that right stands regardless of anything in this section.
How to ask. Email support@remixary.com. We reply to refund enquiries within 2 business days. Approved refunds are processed by the merchant of record and normally reach your original payment method in 5–10 business days.
If you believe you have been charged in error, contact us before raising a chargeback — we would rather fix it directly, and we can usually do it faster than your bank can.
You keep all rights in the material you upload and in the output generated for you. You grant us a limited licence to process, store and transmit that material for the sole purpose of operating the service for you.
You are responsible for having the rights to what you upload. Uploading a competitor's advertisement for analysis does not transfer any rights in it to you, and does not entitle you to reproduce it. Remixary is built to derive a new advertisement from the structure of a reference, not to copy it.
The service itself — the software, interface and brand — remains ours.
Your use of the service is also governed by our Acceptable Use Policy, which lists prohibited content and conduct and explains how to report violations. Breaching that policy is a breach of these Terms.
We may suspend or terminate an account that breaches these Terms or the Acceptable Use Policy, that is used unlawfully, or that puts the service or its providers at risk. Where circumstances allow we will tell you why and give you a chance to respond.
You may stop using the service at any time. On termination, unused credits are forfeited unless the termination was our fault, in which case contact us.
To the extent permitted by law, we are not liable for indirect or consequential loss, including lost profits or lost advertising performance. Our total liability for any claim is limited to the amount you paid us in the three months before the claim arose.
Nothing in these Terms excludes liability that cannot lawfully be excluded.
We may update these Terms. If a change materially affects your rights we will notify you by email or in-product before it takes effect, and the version number and effective date above will change. Continuing to use the service after that means you accept the new version.
These Terms are governed by the laws of the operator's place of residence. Before starting formal proceedings, please contact support@remixary.com so we can try to resolve the matter directly.
